These terms and conditions govern sales completed through the website RUGBY SHOP,
These terms and conditions apply to the exclusion of all other conditions.

1. Terms and Conditions

Protection of Minors :
Minors do not have legal capacity to enter into a contract and any collection of data is subject to parental consent which may prohibit such data being stored and/or disclosed to third parties.

The offer :
Length of validity: offers on the site are valid for the duration that they are present online. Territorial scope: offers are valid for all online purchases, without geographical restrictions, unless otherwise stated. We make every effort to ensure that our products and services provide you with complete satisfaction.

Validation :
Every order assumes prior knowledge and full acceptance of the terms and conditions without reservation, which cannot be challenged except in the circumstances provided in this contract. So when you click on "Confirm my order" at the end of the checkout process, you agree that that you have fully accepted this as well as the general terms and conditions.

Availability and Delivery :
The processing and preparation of shipments is usually completed within 24 working hours (from Monday to Friday) following the receipt of your order.

Items offered on the site are available whilst stocks last. In case of stock shortages or delays, the customer will be informed of the delivery date within 48 working hours, after the receipt of the order, by email, telephone or by post. In this case, the customer is able to cancel or modify his order.

  • Delayed : this means that the item is temporarily out of stock and that it will be delivered to you within the indicated estimated delay time.
  • Out of stock : this means that unfortunately the item is out of stock permanently and will therefore not be delivered to you. Contact our Orders team either by telephone on 0892 259 200 (0,34€/min) (+33 534 273 273 if you are outside of France), or via our contact form. Therefore you have two options: either choose another item to replace the one that is out of stock, or do not choose another item. In the latter case, if your order has been paid for by cheque or by bank transfer, you will be credited to the corresponding value of the out of stock items against your next order, or you could simply ask for a refund. For orders paid for by credit/debit card, items that are not in stock or not immediately available are not debited from your account.

Items ordered will only be supplied once payment has been received.

2. Prices and Special Offers

Prices of items :
For countries which are exempt from VAT of the European Union, the price before tax will be confirmed during the order after the destination has been indicated. The recipient shall be responsible for customs duties tax or local VAT which can be claimed by local authorities.

The tarif applicable to the ordered item is that which appears on the site on the day of the order.

Our displayed prices include all taxes calculated at our warehouses. Shipment is by recorded delivery or by international carrier. We are responsible for part of the postage and packaging fees and we require a contribution from you for these fees.

Prices may be changed without notice to you and may be subject to varying conditions imposed upon us by our suppliers against our will.

The seller retains the sole and exclusive ownership of the goods sold until full payment of the price.

Special Offers :
All special offers notified to the customer by post or email may be used on internet orders within the limits of the conditions specified in the offer. In order to benefit from these discounts and gifts, the SPECIAL OFFER CODE must be stated in the "Discount Codes" box during the order process. If this code is not stated, the application of the offer is at the sole discretion of Rugby sHop.

Discounts and gifts linked to offer codes shall be applied automatically when your order is processed under the conditions specified above.

Special offers cannot be combined with items whose prices are already reduced or at a special price or classed as 'bargains', or at a special price for bulk orders.

3. Postage, Delivery and Transport Fees

Items are delivered to the address indicated by the customer.
Postage costs and delivery time applicable to orders on the site are directly linked to the geographical area (country) to which the customer's desired destination address resides.

Transfer of risk :
In the event of damage or missing items, the customer should refuse the package. Otherwise, he must record his observations on the necessary shipping documentation and confirm his reservations by recorded delivery (recorded letter with acknowledgement of receipt) to the shipping company within 48 hours of receipt of the goods, according to articles 105 and onwards of the international commercial code.

In the event of nonconformity of the item/s delivered, the merchant undertakes to refund or exchange the item/s as soon as possible.

4. Guarantees

Exchange or Return :
The consumer has a period of seven working days to exercise his rights of withdrawal without reason or pay penalties, with the exception of return fees.
If an item does not give complete satisfaction or if it does not fit you, you can return it within ten days with the receipt, as long as you complete the coupon on the reverse of the receipt. The item you wish to exchange must be sent back new and unwashed. Returns should be made by recorded delivery.

For all distance sale transactions, the buyer has a period of 7 days following delivery of his order to return the item to the seller to either exchange or refund it without penalty, excluding return fees. The right of withdrawal requires that the merchant refund the sums paid by the buyer within 15 days of the receipt of the item by the company.

For every returned item that you have paid for, the following terms shall apply :

  • The package was returned without having been opened: refund for both the item and postage fees.
  • The item is returned simply because you are not satisfied: refund of the item and outward shipping fees, but you must pay to return the item.
  • The item is returned due to a fault caused by Rugby sHop: refund of the item, postage and return fees.
  • In the event of return or cancellation, a credit note will be given. Nevertheless, an immediate refund is possible if requested by the customer.

5. Law and Taxes, Customs

Regulations are fixed by the European Union.

Shipment to an EU country (European Union) :
For all packages sent to the invoice address :

  • If the recipient is liable for VAT in the destination country : the invoice will be exempt from tax after verification of the identification number.
  • If the recipient is not liable for VAT: the invoice will include French VAT.

For all gift packages paid for in France :
The invoice includes all taxes.

Shipment outside of the European Union :
The invoice is exempt from taxes and duties.

Custom duties of the destination country and import restrictions :
Customs duties to be paid upon arrival are the responsibility of the recipient.
Local import duties are not the responsibility of Rugby sHop.

The contract is subject to French law, both substantive rules and the rules relating to form. As a result, it is the buyer's responsibility to verify the possibility of importing their ordered product into the country of delivery.

6. Payment

Rugby sHop is equipped with a secure method of payment PAYZEN ; which means that your credit/debit card number as well as your order are encrypted and are never passed on to other internet sites. Their confidentiality is therefore preserved.

Payment by bank card online : Enter the 16 numbers of your card and your card expiration date. You will only be charged for the item/s and postage fees on the day the goods are sent.
NB : Direct payment by credit/debit card guarantees the immediate processing of your order.

Payment by credit/debit card online by 2 or 3 instalments without excess charge : Rugby sHop allows you to pay by credit/debit card twice (if your shopping cart includes over 99€ worth of items) and three times (if your shopping cart has reached over 150€ worth of items) without any additional cost. According to these payment conditions, the total sum of your order will be divided into two or three equivalent parts, charged respectively on the shipment of your items, then 30 days after the shipment, and then after 60 days in the case of three times without charge.

Payment by cheque : Choose to pay by cheque: the instructions for sending your payment are displayed, and you will also find these in your email order confirmation.
Stocked product is reserved for you for 10 working days after your order has been processed. After this period and if your payment has still not been processed, your order will be considered as null and void and the stock will be released for free sale.

Payment by cheque by 2 or 3 instalments without charge : Rugby sHop allows payment by cheque twice (if your shopping cart includes 99€ worth of items) and three times (if your shopping cart includes 150€ worth of items) without any extra charge. According to payment conditions, you are responsible for ensuring that we receive the two or three cheques corresponding to your choice of payment within 10 days. You will be informed during your choice of payment method of the required sum for each of the cheques. They will be cashed respectively following the shipment of your items, then after 30 days of shipment, and finally after 60 days in the case of three times without additional charge.

Payment by bank transfer : Choose to pay by bank transfer: instructions for transferring money are displayed, and you will also find confirmation of your email order confirmation. Your order will be shipped to you once the transfer has been processed and correctly credited to our account.

Payment in shop : For an order that you have chosen to "Collect in Shop", Rugby sHop allows you to pay for the item directly at the till in the shop at St-Alban (31) (more information on our page "Sales Till"). Here you can pay for your purchases by cash, cheque or credit/debit card.
If you choose this method of payment, the items will be reserved for a maximum of 5 working days. If you do not pick up your order before this deadline, your order will be considered as null and void and the stock will be returned to sale.

7. Disputes Applicable Law - Jurisdiction

The contract is written in French.
In cases where the customer is not a French citizen, disputes related to Rugby sHop will be subject to French jurisdiction. These measures do not deprive members outside of mainland France of the application of the rules laid down in international conventions.

Jurisdiction : these terms and conditions are based on French law. All disputes that are likely to arise between parties concerning, among others, validity, interpretation, execution or termination of the contract will be resolved by the court in Toulouse, France or by the applicable jurisdiction in the place of delivery.

8. Data Security

We aim to ensure the security of personal data via strict procedures throughout our business. For data collected "online", we use the secred payment service Paybox which guarantees you a high level of protection, throughout all of your transactions.

All information which is transmitted is encrypted; the confidentiality and security of your transactions are guaranteed.

9. Intellectual Property

The use of this web service is strictly reserved for personal use.

For service requirements, Rugby sHop retains the right to collect a list of names of site users, notoably via the use of "cookies".
In this respect, Rugby sHop is registered with CNIL under the identification number 312428.
